Terms & Conditions - the boring but important stuff.

Your Contract with Emily and the Whippet.

When you place an order with or use the services of Emily and the Whippet, it is subject to terms and conditions. I reserve the right to change and/or amend these terms and conditions at any time. As soon as any changes are placed onto www.emilyandthewhippet.co.uk they come into effect immediately. Please ensure that you read the full terms and conditions when you visit the website, as your continued use of the website signifies that you accept them. If you have questions or are unsure of anything within the terms and conditions or on the website, please contact me at info@emilyandthewhippet.co.uk before placing any orders. If there are any amendments to the terms and conditions, specific to your order, they will be sent directly to you in writing.

Order process, deposit and payment

When you agree to purchase a product or service from Emily and the Whippet you will be sent an order summary, outlining the full cost of your order. For custom illustrations, work will begin on your drawing once I have received full payment for the drawing and the photos you wish me to draw from. Work will then begin on your illustration/s which will take approximately a few weeks though the exact expected time frame for your illustration will be stated on each page of the custom service. For up to date processing times you can contact myself at info@emilyandthewhippet.co.uk. Once your drawing has been completed, you will be sent a proof copy of you illustration/s for your approval. Your approval must be confirmed in writing and returned to me. It is your responsibility to check the illustration thoroughly for details and mistakes before you approve it. If you have asked for a coloured background to be added, this will be discussed during the illustration process. This will also need your written approval once finished and will be considered approved when you approve the finished illustration proof. Once fully completed, your artwork will be sent to our professional printers to be printed if for a physical product and for digital products your illustration will be sent to you electronically. Once sent to the printers, no further changes can be made to the artwork and, if you decide you do want something changed at this point, you will be liable for further payment. For all items, custom or otherwise, production will be started following payment.

Processing Period

The majority of the products available from Emily and the Whippet are custom made to order. With orders of this nature there is a processing period which allows your order and others ordered prior to it to be created and sent out. Non-custom item orders will begin to be processed following payment. For the majority of items, this processing period is two to three weeks but for up to date processing times, please contact info@emilyandthewhippet.co.uk. Processing times may vary between products but this will be stated on the products page. All orders will be produced in the order that we receive them. If you need your order by a certain date, please contact us at info@emilyandthewhippet.co.uk BEFORE making your order to see if we can accommodate this.

Pricing

The www.emilyandthewhippet.co.uk shop will always show the most up to date prices. Other than the additional cost of postage, all prices you see online are what you will pay with no hidden costs. Please contact info@emilyandthewhippet.co.uk if you require more information on pricing for custom orders.

Deadline Estimates for Custom Orders

When you order from Emily and the Whippet, we will discuss the estimated time scale for your custom orders production. Please allow enough time for processing times and for your illustration to be checked, approved, printed and delivered. Occasionally there are circumstances beyond our control that will prevent a deadline being met. On the rare occasion this may occur, you will be contacted and kept aware of any changes or delays. If you need your order by a certain date, please contact us at info@emilyandthewhippet.co.uk BEFORE making your order to see if we can accommodate this.

Postage/Shipping

Shipping upgrades are available on purchase but please keep in mind that these upgrades are for the delivery of your order, not to speed that it will be made. If you would like to pay an additional cost to rush your order to the front of the queue, please contact info@emilyandthewhippet.co.uk for a custom cost for this. This additional cost will take into account how busy we are at that time.

We highly recommend that all orders be sent via a tracked service for speed and piece of mind. Please not that tracking numbers are ONLY provided when this option has been selected and paid for at time of purchase. Items are not automatically sent via tracked or signed for post unless otherwise stated. All items are sent via Royal Mail unless otherwise stated. Emily and the Whippet cannot be held responsible for any issues or delays caused by the carrier. Any customs fees and/or import tax incurred during the shipping process is your responsibility and must be paid by you in full. Items can be held up in customs for a variety of reasons beyond our control and tracked shipping can be purchased prior to your order being dispatched for your piece of mind. Emily and the Whippet is not responsible for any delays caused by customs.

If you provided us with the wrong shipping address and need to change it, please contact info@emilyandthewhippet.co.uk as soon as possible with the correct address. We cannot guarantee that we will be able to make changes to your address prior to it shipping in these circumstances but if the item is returned to us by the incorrect party, we can post it out again to the correct address at your request. In this situation, you will need to pay the postage cost prior to it being dispatched a second time.

We will not be able to give any refunds to items in these circumstances as the error is not our own.

Copyright and Ownership

Once full payment has been received, you will become the owner of all physical products produced for you however, you will not own the artwork created for the design process. The ownership and copyright of the design and/or artwork will always belong to Emily Barr of Emily and the Whippet. You must not reproduce, share or use the designs for any other purpose than those outlined in your initial order. If you would like further copies of your item or artwork, contact info@emilyandthewhippet.co.uk to see if this can be arranged. If you post your item or custom artwork online, please credit www.emilyandthewhippet.co.uk and/or tag @emilyandthewhippet if on Instagram. You cannot use any physical or digital item created or designed by Emily and the Whippet for any work associated with a business without written consent and agreement from Emily and the Whippet.

Refunds, Cancellations or Returns

All of our products are checked for quality by ourselves before being dispatched, with the exception of products sent to you directly from our manufacture. These are quality checked by the manufacturers and I don’t see them personally before they are dispatched. Our products will never leave us damaged or faulty so if they arrive with you in a poor or damaged condition, please contact info@emilyandthewhippet.co.uk within 14 days to see if there is anything we can do to help you.

In this case of the item needing to be returned, you must return the item to us within a further 14 days of the return being agreed.

Any products which are custom made or personalised cannot be returned. However, in the unlikely occurrence that there is a problem with your order that has resulted from something that has happened at our end, I will happily repair the item or send you a swift replacement on its return to me. For made to order items, your product will be discussed with you and made in a style as close to the photographed item as possible although pattern placement may vary. In this case, we are not able to accept returns due to the placement of the pattern. We also can’t process refunds for custom items once you have approved the illustration. It is your responsibility to check the illustration thoroughly for details and mistakes before you approve it. Once work has begun on your custom item, Emily and the Whippet is unable to process any refunds on the product/s. In exceptional circumstances, Emily and the Whippet may provide a partial refund on custom items at their discretion.

For non-custom items, unless otherwise stated, you will be purchasing the item in the photos of the listing or an exact copy. Please note that items may appear to be a slightly different colour due to differences in computer monitors. Natural lighting is used for all photographs which may also vary. Returns cannot be accepted for items you have, or have had, modified in any way so you must not attempt to fix any issues yourself. Any tampering to the product will make this return void.

Unfortunately, once an item has been dispatched, I am unable to control how it is treated. Therefore we will not be able to accept any requests for a replacement for issues that have occurred after this point. We strongly recommend upgrading your postage to tracked, as if your item is late arriving, we will be unable to process you a refund until Royal Mail had deemed it to be lost.

Limitation of Liability

Please be aware that Emily and the Whippet cannot accept liability for damaged or faulty goods if you do not make us aware within 14 days of receipt. We cannot be held responsible for any loss, costs or damages, whether direct or indirect, no matter how they occur (including loss of business or damage to business relationships) resulting from any of the following: inaccuracies or errors of content on the website, the transmission of viruses, bugs or similar, which may be spread to or through the website by a third party, the unauthorised access to, or use of our system and/or any and all personal data stored on it and any downtime of the website itself.

Third Parties

According to the Contracts (Rights of Third Parties) Act 1999, this contract does not give any person who is not a party to it any right to enforce its terms.

Invalidity and Jurisdiction

In the event that any part of these terms and conditions is deemed unenforceable (including any clause in which we exclude our liability to you) this will not affect the enforceability of any other part of these terms. This contract is governed by British law and is subject only to the jurisdiction of the British courts.
